Disputing a Will

It is very common for people to have concerns about the way in which a family member or friend’s Will has been prepared or signed.

We are regularly contacted by people who believe that a Will may have been made:

  • At a time when the person was unable to know what they wanted or what they were doing by reason of, for example, physical or mental illness, the onset of old age or the influence of alcohol, drugs or medication.
  • Without being properly “executed”. Specifically, the Will has not been correctly signed and witnessed.
  • As a result of undue pressure or influence being exerted by someone else.

In these scenarios it may be that the Will is invalid. In that case the invalid Will is worthless and the assets will be distributed in accordance with any earlier Will or under the Intestacy Rules.

We have a depth of experience advising on Will claims and challenging Wills before the Court.

We also understand that some clients simply want to investigate the circumstances in which a Will was prepared to try and understand why a Will may have excluded them or left them a smaller share than they were expecting.
