Trust disputes and disputes involving executors

The responsibility for ensuring that the beneficiaries under a Will or a Trust receive what they are entitled to rests with the appointed Executors and Trustees respectively.

However, problems can occur where:

  • Executors/Trustees fall out with the beneficiaries. This can quite often occur simply as a result of a failure to provide sufficient information to the beneficiaries.
  • Executors/Trustees either fall out or have a disagreement, which then prevents the proper administration of the Estate or Trust.
  • Executors/Trustees fail to comply with their responsibilities, often resulting in a loss to the beneficiaries.
  • Executors/Trustees failing to act quickly and causing delay in administration.
  • There is a disagreement as to the correct meaning or interpretation of a Will or Trust.
