Challenging wills

Our solicitors specialise in disputes involving wills, intestacy, administration of estates and trusts.

We can advise on:

  • Applications challenging the content of wills
  • Applications seeking clarification as to the meaning of wills where its provisions are unclear, or inconsistent
  • Applications challenging the validity of wills including where the capacity of the deceased is in dispute
  • Applications seeking greater provision than set out in the will (or under intestacy if no will exists)

We find solutions and avoid courts altogether if possible. Disputes are regularly resolved via negotiation or formal mediation. Only a fraction of cases ever end up in court. Of those that do, we have experience of high court, county court and court of protection work (at all levels).

The partners who head the specialist team are both members of the Association of Contentious Trust and Probate Specialists, the only organisation which recognises expertise in this complex area of law.

In suitable cases we may be able to deal with your claim on a conditional fee (‘no win no fee’) basis. We will explore all funding options with you.

We are able to act for you if the estate concerned is based in England and Wales or the deceased was living in England and Wales.  We regret that we are unable to assist with claims based in other jurisdictions, such as Scotland or Northern Ireland
