Street Works Prosecutions

Under the New Road and Street Works Act 1991 (“the Act”) a business intending to carry out street works must comply with a number of requirements. These include:

  • Providing suitable notice in advance of carrying out street works.
  • Ensuring that adequate guarding and lighting is used when the street works are being performed.
  • Ensuring that sufficient traffic signs are placed and maintained when the street works are being performed.
  • Reinstating the road or pavement to a sufficient standard.
  • Providing notice once the street works have been completed.

We have experience advising upon and defending clients prosecuted under the Act.

How can we help you?

  • Advising upon your obligations under the Act.
  • Providing advice upon charges being brought against you under the Act and the potential level of any fine that might be imposed by the Court.
  • Providing representation in respect of prosecutions brought under the Act in the Magistrates and Crown Courts.
