Pre-nuptial agreementsNo one goes into a marriage with the thought that it will end in divorce but should your relationship fail is it possible to protect your finances? Pre-nuptial agreements (pre-nups) are made by couples before they marry. The agreement can set out how the couple wish to arrange their finances during their marriage and how they would like them to be divided between them on separation and divorce. In international divorces, pre-nups are a common feature. They are enforceable in many jurisdictions around the world but they are not (yet) strictly enforceable in England. Recent case law, however, has shown that on divorce in some financial cases a pre-nup can carry decisive weight about how assets are divided. In most financial cases on divorce, the terms of a pre-nup will, at least, be taken into account in how finances are resolved.
